Terms of Use

Welcome to Spotary. These Terms of Use ("Terms") govern your access to and use of the Spotary mobile application ("App") and services ("Service") provided by SIA Horizon C, registered in Latvia (registration number 40203709918). By creating an account or using Spotary, you agree to these Terms.
1. Eligibility
You must be at least 16 years old to use Spotary. By using the App, you confirm that you meet this requirement.
2. Your Account
You are responsible for keeping access to your account secure (including the email inbox or the Google or Apple account you use to sign in), for all activity under your account, and for notifying us of any unauthorised access. We may suspend or remove accounts that violate these Terms or pose a security or legal risk.
3. User-Generated Content
You are solely responsible for all content you post ("Content"). By posting Content, you confirm that:
- You own the rights or have permission to use it;
- It does not violate any law, privacy rights, or intellectual property rights;
- It does not include private information about others without their consent;
- You understand that Spotary does not verify the accuracy or safety of any location or information submitted by users.
We reserve the right (but are not obligated) to review, remove or restrict Content that violates these Terms or applicable law.
4. Creating Posts
You may create posts containing at least one image, with optional description, location, hashtags, and tagged users. Each post has configurable visibility and interaction settings. You are solely responsible for all Content you post, including any media, location data, descriptions, and tags.
5. Privacy and Visibility
- Public posts: visible to all registered users; location is shown only to your followers, and only if you explicitly enable it for that post.
- Followers-only posts: visible to your followers; location is shown only if you explicitly enable it for that post.
- Only me: visible only to you.
- Delayed visibility: you can delay a post by 24 hours. During that time it is visible only to you and the users you tagged.
Anyone can follow a public profile without approval. Private profiles approve each follow request. Spotary does not override your chosen visibility settings.
6. Tagging Users
You may tag other users in your posts, subject to mutual follow requirements. Tagged users may remove themselves from any post at any time.
7. Feed & Community Map
The feed shows posts you are allowed to see, including public posts. The location of a post is visible to you only if you follow its author and the author has enabled location for that post. The Community map shows only posts from users you follow whose authors have allowed their location to be shown to followers; tapping a marker opens the post details.
8. Location Features
Location is always optional and is not tracked in real time or in the background. When creating a regular post, you choose and confirm the location yourself by placing or dragging a marker on a map; the App may suggest a location found in your photo's metadata, which is used only if you accept it. In Quick Post, the App may pre-fill your current device location (or the location stored in your photo) to save time. You can switch it off with "Include location in post" or change its source before saving or publishing.
- Any profile, public or private, may share a post's location with its followers on a per-post basis, only if explicitly enabled (off by default). People who do not follow you cannot see it.
- The Community map shows the location of posts from people you follow, only where the author has allowed it. In "Nearby" mode it may use your approximate current location to filter content; in "Users" mode you can pick up to 5 people you follow. Your location is used only for that request and is never stored or shared with other users.
- Routes you create are private to you unless you choose to share them with your followers. Directions are calculated by a third-party service (see the Privacy Policy and Location Safety pages).
- Location drafts and Quick Post drafts created offline are saved only on your device. A Quick Post draft is uploaded to our servers only when you press "Publish" while online.
If you navigate to a location or follow a route, including via an external maps application, you do so at your own responsibility. Spotary does not verify the accuracy, safety, or legality of any location or route.
9. Messaging
Messages are visible only to the participants of that conversation. Messages are automatically deleted after 60 days. You may also delete individual conversations at any time. You agree not to use messaging to harass, abuse, or threaten others, send spam, or share illegal, hateful, or violent content.
10. Notifications
The App generates notifications for social interactions such as likes, comments, replies, and new followers. Notifications are automatically deleted after 30 days and may also be deleted manually at any time.
11. Comments
You may interact with comments on posts. Post authors may delete any comment on their own posts. Any user may report a comment that violates these Terms.
12. Safety, Blocking and Reporting
Spotary provides tools to block users and report content that violates these Terms or is abusive or harmful. We may review reports and, at our discretion, remove content or restrict accounts. We do not guarantee that all content will be monitored or removed.
13. Account Restrictions
If a report is submitted against your account, certain features may be temporarily limited while we review the matter. You will be notified within the App if your account is subject to restrictions. You may continue to use the App, but certain actions may be unavailable during the review period.
14. Prohibited Conduct
You may not:
- Post illegal, hateful, violent, or sexually explicit content;
- Share private or sensitive personal information of others without their consent;
- Post misleading or harmful location data for the purpose of harassment, stalking, or endangering others;
- Attempt to hack, disrupt, or reverse-engineer the Service;
- Use bots, scrapers, or automated tools to access Spotary.
15. Intellectual Property
We retain all rights in the App, software, design, logos, and branding. Your Content remains yours, but by posting it you grant us a non-exclusive, worldwide licence to host and display it within the App for the purpose of operating the Service.
16. Disclaimers
Spotary is provided "as is" and "as available", without warranties of any kind. We do not guarantee that locations are accurate, safe, or lawful; that Content is true or verified; or that the App will be error-free or uninterrupted.
17. Limitation of Liability
To the maximum extent permitted by law, Spotary and its owners are not liable for incorrect or misleading locations; any harm or damage arising from visiting places shown in posts; user behaviour or Content; or loss of data, account access, or service interruptions.
18. Governing Law
These Terms are governed by applicable laws in your local jurisdiction, unless otherwise required by mandatory law.
19. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you in advance within the App. By continuing to use the App after such notification, you agree to the updated Terms.
