Welcome to Spotary. These Terms of Use ("Terms") govern your access to and use of the Spotary mobile application ("App") and services ("Service") provided by SIA Horizon C, registered in Latvia (registration number 40203709918). By creating an account or using Spotary, you agree to these Terms.
1. Eligibility
You must be at least 16 years old to use Spotary. By using the App, you confirm that you meet this requirement.
2. Your Account
You are responsible for keeping your password secure, all activity under your account, and notifying us of any unauthorised access. We may suspend or remove accounts that violate these Terms or pose a security or legal risk.
3. User-Generated Content
You are solely responsible for all content you post ("Content"). By posting Content, you confirm that:
- You own the rights or have permission to use it;
- It does not violate any law, privacy rights, or intellectual property rights;
- It does not include private information about others without their consent;
- You understand that Spotary does not verify the accuracy or safety of any location or information submitted by users.
We reserve the right (but are not obligated) to review, remove or restrict Content that violates these Terms or applicable law.
4. Creating Posts
You may create posts containing at least one image, with optional description, location, hashtags, and tagged users. Each post has configurable visibility and interaction settings. You are solely responsible for all Content you post, including any media, location data, descriptions, and tags.
5. Privacy and Visibility
- Public posts: visible to all registered users; location is shown only to approved followers if you explicitly enable it for that post.
- Followers-only posts: visible to approved followers; location is shown only if you explicitly enable it for that post.
- Only me: visible only to you.
Spotary does not override your chosen visibility settings.
6. Tagging Users
You may tag other users in your posts, subject to mutual follow requirements. Tagged users may remove themselves from any post at any time.
7. Feed & Discovery
The App provides a feed of content from users you follow, as well as a discovery mode showing public posts from other users.
8. Location Features
Location is always optional. You choose and confirm your location yourself by manually placing or dragging a marker on a map — no location is ever attached automatically. Location is not tracked in real time or in the background.
- Public profiles cannot share location data on any post regardless of settings.
- Private profiles may share location with their followers on a per-post basis, only if explicitly enabled.
- The Explore feature may use your approximate current location to filter nearby content on the map. This data is used only for filtering within that request and is never stored or shared with other users.
- Location drafts created while offline are saved only on your device and are never synced to our servers.
If you navigate to a location via an external maps application, you do so at your own responsibility. Spotary does not verify the accuracy, safety, or legality of any location.
9. Messaging
Messages are visible only to the participants of that conversation. Messages are automatically deleted after 60 days. You may also delete individual conversations at any time. You agree not to use messaging to harass, abuse, or threaten others, send spam, or share illegal, hateful, or violent content.
10. Notifications
The App generates notifications for social interactions such as likes, comments, replies, and new followers. Notifications are automatically deleted after 30 days and may also be deleted manually at any time.
11. Comments
You may interact with comments on posts. Post authors may delete any comment on their own posts. Any user may report a comment that violates these Terms.
12. Safety, Blocking and Reporting
Spotary provides tools to block users and report content that violates these Terms or is abusive or harmful. We may review reports and, at our discretion, remove content or restrict accounts. We do not guarantee that all content will be monitored or removed.
13. Account Restrictions
If a report is submitted against your account, certain features may be temporarily limited while we review the matter. You will be notified within the App if your account is subject to restrictions. You may continue to use the App, but certain actions may be unavailable during the review period.
14. Prohibited Conduct
You may not:
- Post illegal, hateful, violent, or sexually explicit content;
- Share private or sensitive personal information of others without their consent;
- Post misleading or harmful location data for the purpose of harassment, stalking, or endangering others;
- Attempt to hack, disrupt, or reverse-engineer the Service;
- Use bots, scrapers, or automated tools to access Spotary.
15. Intellectual Property
We retain all rights in the App, software, design, logos, and branding. Your Content remains yours, but by posting it you grant us a non-exclusive, worldwide licence to host and display it within the App for the purpose of operating the Service.
16. Disclaimers
Spotary is provided "as is" and "as available", without warranties of any kind. We do not guarantee that locations are accurate, safe, or lawful; that Content is true or verified; or that the App will be error-free or uninterrupted.
17. Limitation of Liability
To the maximum extent permitted by law, Spotary and its owners are not liable for incorrect or misleading locations; any harm or damage arising from visiting places shown in posts; user behaviour or Content; or loss of data, account access, or service interruptions.
18. Governing Law
These Terms are governed by applicable laws in your local jurisdiction, unless otherwise required by mandatory law.
19. Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes means you accept the updated Terms.
